Doug, I'll betcha that just about every user of the GMRS radio has no regard for which frequencies and be used at what power levels.

And last I heard, the FCC has not made this its priority enforcement issue.

Almost certainly correct. Not only that, I'll bet that the majority of users don't even know the difference, technically or legally.

It has been that way for quite a while...

However, the manufacturers are a visible and (relatively) stable target. General coverage receivers are requred to block out cell phone frequencies (a poor quality attempt at security-after-the-fact)--it would seem prudent that general public oriented transmitters not be designed in ways that make use on illegal frequencies so easy. (OTOH, AFAIK it is not illegal to own a transmitter that you cannot operate legally in the USA.)
